This Privacy Policy (“Policy”) describes the privacy practices of The American Printing House for the Blind (“APH”, “we”, “us”, and “our”) with respect to Personal Information (defined below) collected from or about individuals who access or use our website (“you” or “your”) at https://www.aph.org/ (the “Website”) and any associated features, applications, products, resources, or services owned or operated by us or on our behalf that link to this Privacy Policy (collectively, the “Services”).

This Privacy Policy explains what Personal Information may be collected from or about you when you access or use the Services, how we and others may use Personal Information, under what circumstances we may disclose Personal Information, and the instances in which we may allow third parties to collect Personal Information from or about you. Depending on your activities when using or accessing our Services, you may be required to agree to additional terms and conditions.

This Privacy Policy applies regardless of whether you use our Services via a computer, mobile device, or other platform (collectively, your “Equipment”).

This Policy applies only to Personal Information we collect:

Through the Services.
In communications, including email, text, chat, and other electronic messages, between you and us through the Services.
When you interact with our advertising on third-party websites and services, if that advertising includes links to this Policy.

This Policy does not apply to Personal Information collected by:

Us through any other means, including on any other website operated by us or any third party that does not link to this Policy.
Any third party whether through any website, application, services or content (including advertising) that may link to or be accessible from or through the Services.

PLEASE NOTE: Where required, we may provide additional, supplemental, or separate notices in connection with specific jurisdictions, features, products, or services. Any such supplement or notice forms part of this Policy and will control in the event of a conflict as to the individuals, jurisdictions, features, products, or services covered by that supplement or notice.

Please review this Privacy Policy carefully before using our Services. By interacting with our Services or providing us with your Personal Information, you agree to the collection, use, and sharing of your Personal Information as described herein, unless applicable law requires separate consent. If you do not agree to the terms of this Privacy Policy, please do not use the Services. We reserve the right to modify or change the terms of our Privacy Policy (see Material Changes to this Privacy Policy).

This Privacy Policy does not apply to information that is de-identified or anonymized (consistent with applicable law) or to information that is not Personal Information under applicable law.

B. Personal Information We May Collect

For purposes of this Privacy Policy, “Personal Information” (also known as “personal data”) means information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual.

When you use the Services, we may collect the following Personal Information from or about you:

Identifying and Contact Information such as your first name, last name, mailing or delivery address, email address, date of birth (when needed for federally mandated programs such as the Federal Quota Program), and phone number.

Donor Information such as the donor’s contact details, giving history, participation in events, receipt of our publications, requests for program information, feedback or comments, and stated preferences for communications from us. See our Donor Privacy Policy for additional information.

Financial Information such as billing address and other payment-related information. Please note, when you access our Services to make a payment, you may be redirected to, or interact with, a third-party payment processor that may collect and retain your financial information to process your payment in accordance with their own privacy policies. We may retain the last 4 digits of your payment method.

Employment-related information such as employment status and pre – and post – project wage outcomes, including information collected through the Monarch RISE Project’s adult training programs for federal Disability Innovation Fund grant outcome reporting, as relevant to specific Services offered by us.

Education-related information such as grade level.

Commercial Information including details of our products and Services (including apps) that you have purchased, obtained, used, or considered.

Consumer Health Information including information relating to eye functionality, diagnosis of autism or attention deficit disorders, CHARGE syndrome, cerebral palsy, hearing impairment, speech or language impairments or communication disorders, intellectual disability, Usher Syndrome, or other health information or diagnoses you disclose to us, including information collected through the Monarch RISE Project’s participant applications and surveys. Where required by law, we collect, use, and disclose this information only with your consent or as otherwise permitted, required, or authorized by law. Profile Information including your account login information such as username and password, purchases or orders made by you, your interests, profile image, preferences, feedback, and survey responses.

Preferred Reading Medium such as large print, audio, or braille.

Marketing and Communications Information such as your preferences in receiving marketing from us and our third parties and your communication preferences.

Geolocation Information such as your city and state of residence or your zip code.

Technical Information including internet protocol (IP) address, language preference, browser type and version, time zone setting and location (including as provided by certain third-party service providers to better help the visually impaired), browser plug-in types and versions, Equipment information such as device type, operating system, and platform, and other technology used to access the Services.

Usage Information including information about how you use our Services and the usage frequency of a certain webpage or an application.

Social Media Information such as your name, username, general location, gender, email address, reviews and feedback you provide our organization pages. Please note that information posted to social media is not covered by this Policy.

Sensitive Personal Information, such as consumer health information.

If you disclose any information relating to another person, either to us or to our service providers in connection with the Services, you represent that you have permission to do so and to permit us to use the information in accordance with this Privacy Policy.

PLEASE NOTE: Only provide us the information we request to provide the Services. For instance, if you send us an email, please do not send any sensitive personal information or profile login data, such as passwords, social security numbers, or bank account information.

You may always choose whether to provide us with your Personal Information. If you elect not to provide us with required Personal Information, we may not be able to provide you with our Services.

C. How We Collect Personal Information

We may collect Personal Information as follows:

Directly from you. You may give us information about you by completing forms or by communicating with us by text, e-mail, or otherwise. This also includes information you provide when you create an account, purchase and use our products and Services, register for webinars or other programs, complete a survey, provide feedback, report a problem, or otherwise contact us about our Services, or provide information to be published or displayed on public areas of our Services or transmitted to others, such as through posting comments or reviews or participating in online communities.

Field Test Surveys. You may give us information about you when completing surveys. For example, as part of our commitment to product development and evaluation – especially for new or innovative educational materials – we conduct field test surveys with teachers, parents or guardians, higher education students, professionals, and other users in the field of blindness and visual impairment to evaluate use of our Services.

Federal Quota Program. To comply with federal requirements and secure Federal Quota Funds that provide accessible educational materials for students who are blind or visually impaired, Ex Officio Trustees in each state and territory are required to conduct an annual census of eligible students through the Federal Quota Program. This census determines the number of students below college level who meet the definition of blindness under the Act to Promote the Education of the Blind. Data collected through this census is stored securely in our Student Registration System.

Automatically through the Services. With your consent if required, as you interact with our Services, , we may may use automatic data collection technologies to collect information that may include Personal Information. Information collected automatically may include technical data about your Equipment, IP address, location data, browsing actions, and patterns. We collect this information by using cookies, server logs, web beacons, Wi Fi, or other similar technologies, as described in Cookies and Other Data Collection Technologies below.

From third parties. We may receive information about you from vendors and service providers we hire to help us run our business, including companies that host or operate our Services and platforms, process payments for us, fulfill orders, send emails for us, provide marketing, analytics, and advertising services, or host our content. We may also obtain information about you from advertising networks and search information providers. Additionally, other users of our Services may provide us with your information so that we may invite you to use our Services.

D. Cookies and Other Data Collection Technologies

With your consent if required, we (and our service providers performing Services on our behalf) may automatically receive and store certain types of information when you interact with our Services. For example, we may use cookies to distinguish you from other users of the Services to help us deliver a better and more personalized service when you use our Services. It also allows us to improve our Services by enabling us to:

Our Services pages and e-mails may contain small transparent embedded images or objects known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count website page visitors or email readers, or to compile other similar statistics such as recording Services content popularity or verifying system and server integrity.

To the extent any of these automated technologies are considered a personal data sale, targeted advertising, or profiling, under applicable laws, depending on where you live, you may opt out from use of these automated technologies for such uses. Additionally, if you consented to the use of these technologies, you may always revoke your consent. Please see Your Rights and Choices. Please note that some Services features may be unavailable as a result.

Additionally, when you interact with the Services, there are third parties that may use automatic collection technologies to collect information about your or your Equipment. These third parties may include:

Advertisers, ad networks, and ad servers.
Analytics companies and social media platforms.
Your device manufacturer.
Your internet or mobile service provider.

These third parties may use tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites, apps, platforms, and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

E. How We Use Personal Information

We may use Personal Information to provide you with products, offer you Services, communicate with you, deliver advertising and marketing, or to conduct other business operations, such as using information to improve and personalize your experiences.

We may use Personal Information as follows:

Send you products or provide you with Services that you have requested, including processing payments and providing you with updates about the status of your orders.
Manage our relationship with you which may include notifying you about changes to our Services, Terms of Use, or our privacy policies, providing you notices about your account, asking you to provide feedback or take a survey, or addressing any questions you may have about our products or Services.

F. Disclosure of Personal Information

We may disclose Personal Information as follows:

To our contractors, service providers, and other third parties (such as analytics, technology platform, and advertising providers) we use to deliver our Services to you, support our business operations, and/or enhance user experience. The categories of Personal Information we may disclose to third parties includes identifiers and contact information, Internet or other similar network activity, technical information, usage information, and general location data.
To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about you is among the assets transferred, or for diligence related to such a transaction.
To fulfill the purpose for which you provide the information.
To comply with any court order, law, or legal process, including responding to any government or regulatory request.
To enforce or apply our Terms of Use or other agreements including for billing and collections purposes.
To comply with applicable law, including federal program requirements.
To protect the rights, property, or safety of our business, our employees, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of cybersecurity, fraud protection, and credit risk reduction.
To investigate suspected violations of any law, rule or regulation, or the terms or policies for our Services.
With your consent, consistent with applicable law.
For any other purposes that we disclose when you provide the information.

G. Interest-Based Advertising

As noted above, our Services may integrate technology of third-party advertising networks (“Ad Networks”) that allows for the recognition of your Equipment and the collection of information such as IP addresses, browsing and searching activities, and other technical information as you navigate through our Services. With your consent if required, this information may be used to send you advertisements for products and services that are more likely to be of interest to you.

PLEASE NOTE: These technologies are not used within our educational software, applications, and other student-facing services outside the Website, including https://brailleblaster.org, the software and applications made available at tech.aph.org, and applications distributed through the Apple App Store or Google Play Store.

If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our or our advertisers’ target-audience preferences, or, to share your Personal Information with third parties for promotional purposes, you can opt out or revoke your consent by either engaging with our consent management platform (as available) or contacting us as provided below.

Universal Opt-Out Mechanisms: Further, to the extent we sell or share (as those terms are defined by applicable law) Personal Information, we will honor Universal Opt-Out Mechanisms consistent with applicable law.

Our Services may include links to third-party websites or services or provide you the opportunity to post content. Please note:

Social Networks. Our websites may make available links to access third-party sites operated by social media companies. If you choose to click on such link, then it may collect information about you and send it back to the social media company that owns it. This may happen even if you do not click on the link, if, for example, you are logged into a social media website when you access our Services. Any information collected by a social media company through your interaction with their third-party link and site is subject to the privacy policy and terms of the respective social media company. If you do not want the applicable social media company to collect information about you when you use our Services, sign out of the social media network before visiting or accessing our Services and do not click on their respective link.
Other third-party links. Our Services may link to or contain links to other third-party websites that we do not control or maintain, such as in connection with purchasing products we may recommend or reference via our Services and/or advertisements you may see while using our Services. We are not responsible for the privacy practices employed by any third-party website. We encourage you to read the privacy statements of a third-party website before submitting any personal information through such website.
Forums. We may offer chat rooms, blogs, message boards, or similar public forums where you and other users of our Services can share information and communicate. As noted, the protections described in this Privacy Policy do not apply when you post information (including any Personal Information) to these forums. Further, we may use Personal Information to identify you with a post on any such forum. Any information you share with or on these forums is public information and may be seen or collected by anyone, including third parties that do not adhere to this Privacy Policy. We are not responsible for events arising from the distribution of any information you choose to publicly post or share through our Services.

I. Your Rights and Choices

This section describes mechanisms you can use to control certain uses and disclosures of your Personal Information and rights you may have under state law, depending on where you live.

Email Marketing Information: We will send promotional emails, advertisements tailored to your interests and preferences, or other marketing communications to you if you have requested information from us or purchased products or services from us and you have not opted out of receiving such communications, or with your consent if required by applicable law. If you receive our marketing communications and do not want us to use your email address to promote or recommend our own products and Services, or third parties’ products or services, you may opt-out by replying to any promotional email we have sent you or following the opt-out links on that message. This opt-out generally will not apply to information provided to us related to a purchase, product service experience, or other Service-based transaction.

Accessing, Updating, and Deleting Your Information: You may contact us as set forth in the Contact Us section below to request access to, correction of, or deletion of Personal Information about you in our possession or control, consistent with your rights as described below. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or negatively affect the information’s accuracy.

Location Information: As noted above, when you use our Services, we may automatically collect certain information about the Equipment you are using. This includes the general location of your Equipment through GPS, Bluetooth, or WiFi signals. You may be able to turn off location features on your Equipment.

Cookies and Automatic Data Collection Technologies. You can set your browser or Equipment to refuse some browser cookies or other tracking technology files, or to alert you when these files are being sent. You may also choose whether to allow the Services to collect non-essential information through other automatic data collection technologies at any time through our consent management platform (as available) or by contacting us as provided below. However, if you disable or refuse cookies, please note that some parts of our websites or Services may become inaccessible or not function properly. In some cases, you may be able to set your browser or email program to not download web beacons.

Interest-Based Advertising. Please see Interest-Based Advertising above for information on how to opt-out of interest-based advertising.

Data Subject Access Rights. Depending on in which U.S. state you are resident, you may have the following rights related to your Personal Information. These rights include:

The right to know what Personal Information we process about you.
The right to request certain Personal Information that we process about you be deleted.
The right to request we correct Personal Information we have about you which you believe is incorrect.
The right to have certain Personal Information we process about you returned to you in an accessible and useable format upon your request, if such request is technically feasible.
The right to opt-out of having your Personal Information processed for targeted advertising, sales, or profiling (as those terms are defined by applicable law) .
The right to exercise your data subject rights free from discriminatory treatment.

California Residents. If you are a California resident, you may have additional personal rights and choices regarding your personal data. For example, California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of covered websites that are California residents to request certain information regarding disclosure of personal data to third parties for their direct marketing purposes. Please note that it is our policy not to share covered Personal Information of individuals who have exercised their cost-free right to opt-out of sharing with third parties for their direct marketing purposes as provided below.

Nevada Residents. Nevada provides its residents with a limited right to opt out of certain personal data sales. Residents who wish to exercise their sale opt-out rights may submit a request as provided below. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

Exercising Your Privacy Rights

How We Verify Data Subject Rights Requests

We may require that your identity be verified prior to processing verifiable rights requests. If your request requires verification, we will verify your identity by comparing the information we have about you against the information we receive when you submit your request. If we do not have enough information to verify your identity, we may request additional information from you, consistent with applicable law. We may deny a rights request if we are unable to verify your identity.

Authorized Agents

Some states permit their residents to designate an authorized agent to submit requests to exercise certain privacy rights on the individual’s behalf. Even if you use an authorized agent to submit a request on your behalf, pursuant to applicable law, we may still require that you verify your identity depending on the nature of the request and sensitivity of the information at issue.

If you are an authorized agent submitting a request on behalf of an individual, please submit a request using the contact information provided in the Contact Us section below. You must include a copy of the written, signed permission indicating that you are permitted to act on that person’s behalf.

Appealing a Denied Data Subject Rights Request

In some circumstances, we may deny your request to exercise one or more of the rights described above. Some states grant their residents the right to appeal a denied data subject request. If you disagree with our decision to deny your request or any portion of your request, and your state of residence provides such right, you may appeal our decision within sixty (60) days of receipt of notice that your request has been denied. If you submit an appeal to a denied request more than sixty (60) days after you have been notified of our decision to deny the request, we may deny your appeal. If you submit a timely appeal, we will respond within forty-five (45) days of our receipt of your appeal.

If you wish to appeal a decision, please clearly and plainly describe your reasons for disagreement with our decision by responding through the same means by which we communicated our decision or by submitting your appeal using the information provided in the Contact Us section below. We will review your appeal and either amend or uphold our decision. In either case, we will provide a written explanation of the reason for the decision. This decision will be final.

J. Data Security

The security of your Personal Information is very important to us. We use appropriate physical, electronic, and administrative safeguards designed to protect your Personal Information from loss, misuse, and unauthorized access, use, alteration, or disclosure.

We will continue to enhance and update our physical, electronic, and administrative safeguards as necessary. Please note that the Internet environment is not 100% secure, and we cannot guarantee that information we collect will never be accessed in an unauthorized way.

K. International Transfers of Personal Information

We are a company located in the United States and our Services are provided to individuals residing in the United States. If you are using our Services from outside the United States, you should be aware that the information collected by our Services will be stored and processed in the United States, or any other country in which APH, or its affiliates, subsidiaries, agents, or sub-processors maintain facilities, including hosting services or servers. By providing your information via our Services, you are consenting to the transfer of your information (including via automatic data collection technologies, see Cookies and Other Data Collection Technologies for more information about how we use these technologies) outside of your country in accordance with this Policy and applicable law. You are also consenting to the application of United States law in all matters concerning our Services.

L. Minors’ Online Privacy

Although our Services are directed to a general audience, children under the age of 13 may gain access to some of our Services, such as educational mobile apps. Services that require a user to complete a registration process before using those areas are solely directed to parents or guardians that are at least 18 years of age. Please see our Privacy Policy for Children (available here) for more information about our data practices for children under the age of 13.

M. Family Educational Rights and Privacy Act Notice

APH may provide products or Services to educational agencies and institutions that are subject to the Family Educational Rights and Privacy Act of 1974 (“FERPA”) and its implementing regulations. When APH receives Personal Information from education records in that capacity, APH will handle that information in accordance with FERPA, applicable regulations, and the agreement with the applicable educational agency or institution. APH will not use such information for advertising or other commercial purposes unrelated to providing APH’s products or Services to the applicable educational agency or institution and will not redisclose such information except as permitted by law or authorized by the applicable educational agency or institution.

N. Data Retention

We will retain your Personal Information for as long as reasonably necessary for the purpose for which we collect it or as otherwise permitted or required by law. The retention periods for each category of Personal Information, including sensitive information, vary depending on compliance with relevant laws, your request for deletion, and our retention policies. For example, we may need to retain your Personal Information to comply with our legal or reporting obligations in accordance with applicable laws or to defend against legal claims. Our retention periods are determined by using and balancing the following criteria:

The volume, nature, and sensitivity of the Personal Information.
The potential risk of unauthorized access, use or disclosure, or misappropriation.
The purposes for which we process the Personal Information.
The retention obligations under applicable legal requirements.

O. Material Changes to this Privacy Policy

We may update this Policy from time to time, and we will provide notice of any material changes to the Policy as required by law. The date the Policy was last updated is identified at the top of the page. We will notify you of changes to this Policy by updating the “last updated” date and posting the updated policy on the Services. We may email or otherwise communicate reminders about this Policy, though we encourage you to check our Services periodically to review the current policy and any changes we have made to it. If you object to any change, please stop using the Services.
